REAL ESTATE LAW

LANDLORD/TENANT LAW
The Firm has extensive experience representing the interests of landlords of apartment buildings, manufactured home communities, and other residential communities in a variety of contexts. Moschetti & Associates attorneys have represented the owners and managers of medical office buildings, shopping centers, and retail and warehouse space. The Firm’s experience includes evictions, rent collection actions and lease disputes. Attorneys in the Firm draft leases, lease modifications and extensions, and assist clients in lease negotiations.

Firm attorneys have wide ranging experience drafting residential, apartment, manufactured housing, commercial and office leases. The Firm is also regularly involved in lease enforcement and has addressed fair housing matters for its clients. For its medical office building clients, Moschetti & Associates attorneys are often presented with cases which involve STARK and HIPAA compliance issues.

LENDING AND SECURED TRANSACTIONS
The Firm has represented both state-chartered and national bank as well as non-conventional lenders in transactions involving borrowers and collateral located throughout the United States. The Firm is often asked to secure loans with real estate, water rights and entity interests, by perfection of security interests in personal property, and with letters of credit. As a result of its considerable involvement in lending and in collections, Firm attorneys are regularly involved in mechanic’s lien actions, creditor representation in bankruptcy proceedings; matters involving replevins, attachments, executions; public trustee and judicial foreclosures; and in proceedings to collect notes and other obligations owed to clients.
